Summary: This telegram provides guidance on the required format and content of all Local Compensation Plans. All posts are required to comply with this telegram as soon as possible, and not later than March 1, 2009. See paragraphs 3 and 4 for action required. End Summary. 2. APPLICABILITY AND PURPOSE a. This telegram applies to each Mission with Locally Employed (LE) Staff paid under a Local Compensation Plan (LCP). b. The legal basis for compensating LE Staff who are paid under an LCP is: --the authorized, signed, and implemented LCP; --3 FAM 7000 and other applicable USG regulations and U.S. laws; and --LE Staff compensation policies as may be issued by the Department from time to time. c. It is the Department's goal to standardize the format and content of LCPs in order to: (1) Ensure there is appropriate documentation in the signed LCP of all authorized compensation (salaries and benefits) provided to LE Staff at a specific Mission. (2) Ensure a complete and current signed LCP is provided to the Global Financial Services (GFS) payroll office each time the LCP is revised. It is Department policy and regulation that all compensation be paid through the payroll system to the greatest extent possible. (See ref A.) (3) Ensure a complete and current signed LCP for every post is maintained electronically in HR/OE/CM. 3. LE STAFF HANDBOOK a. The LE Staff Handbook is used to describe employment policies. It must not be used as the official documentation of authorized compensation such as benefit plans. b. All posts are required to include the following conflicts clause at the beginning of the Handbook: "In the event of any discrepancy between (a) the Local Compensation Plan and FAM/FAH regulations and (b) this LE Staff Handbook, the Local Compensation Plan and FAM/FAH regulations will prevail. 4. REVISION OF THE LOCAL COMPENSATION PLAN a. As soon as post's workload permits, but not later than March 1, 2009, each post is required to: (1) update the format and content of the LCP as described in the document entitled "Local Compensation Plan Template" found on the HR/OE Compensation intranet page at: http://hrweb.hr.state.gov/prd/hrweb/oe/Comp/compensate.c fm (2) electronically transmit a copy of the updated LCP in accordance with ref B; and (3) amend the LE Staff Handbook as described in paragraph 3b above. b. Regional HROs are asked to assist your client posts. HR/OE/CM understands that this will be a major project for some posts. However, it is important that that there is an accurate and legal basis for compensation payments. It also should make future revisions to the LCP quicker and easier to implement for both post and the payroll office. c. If post is unable to meet this deadline, please send an unclassified telegram requesting an extension to HR/OE/CM and the Post Management Officer. Include the date by which you expect to be able to complete the STATE 00124885 002 OF 002 project.
